Welcome to Cradle House. By accessing or using our website at cradle.house or any related services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.
2. Description of Service
Cradle House is an online platform designed to help families discover and connect with senior care facilities including assisted living, memory care, skilled nursing, independent living, and continuing care communities. We provide a searchable database, AI-powered matching, facility information with quality ratings, tour scheduling, and communication tools.
3. Eligibility
You must be at least 18 years of age, have the legal capacity to enter into a binding agreement, provide accurate registration information, and not be prohibited from using the Service under applicable law.
4. User Accounts
To access certain features, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials, all activities under your account, and notifying us immediately of unauthorized use. We may verify your identity through SMS, email, or other methods.
5. Acceptable Use
You agree NOT to: use the Service for unlawful purposes, provide false information, impersonate others, harass facilities or users, attempt unauthorized access, use automated means to scrape the Service, interfere with operations, send spam, or violate any laws.
6. Facility Information
While we strive for accuracy, we do not guarantee the completeness or reliability of facility information. Quality ratings may be sourced from CMS, state licensing boards, and third parties. You are strongly encouraged to independently verify all information, visit facilities in person, and conduct your own due diligence before making care decisions.
7. Tour Requests & Communications
When you request a tour, your contact information and care needs may be shared with the selected facility. By submitting a request, you consent to communications from both Cradle House and the facility. Submitting a tour request creates no obligation to use any facility's services.
8. Privacy & Data
Your use is governed by our Privacy Policy. California residents have additional rights under CCPA. When you request information or schedule tours, we share relevant information with facilities including your name, contact information, and specified care needs.
9. Disclaimers
The Service does not provide medical advice, diagnosis, or treatment recommendations. Listing a facility does not constitute endorsement. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee availability, pricing accuracy, care quality, or uninterrupted operation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: Cradle House shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed $100 or the amount paid in the past 12 months. We are not liable for actions of any facility or third party.
11. Indemnification
You agree to indemnify and hold harmless Cradle House from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, violation of third-party rights, or content you submit.
12. Termination
You may terminate your account by contacting support@cradle.house. We may suspend or terminate your account at any time for violation of Terms, fraudulent behavior, extended inactivity, or at our discretion. Upon termination, your right to use the Service ceases immediately.
13. Dispute Resolution
These Terms are governed by Texas law. Disputes shall be resolved through binding arbitration in Dallas County, Texas. You agree to waive jury trial and class action rights. Before arbitration, contact legal@cradle.house and attempt informal resolution for at least 30 days.
14. Changes to Terms
We reserve the right to modify these Terms. Material changes will be notified by email or site notice. Continued use constitutes acceptance of new Terms.
